Hacking / piracy
Software piracy is subject to both civil and criminal penalties.
These are often public proceedings which impact the reputation
of the offending company and/or person and often leads in
a sever loss of customers.
If you are found using unlicensed copies of software, you
and/or your company will be liable for infringement of copyright.
Alambik Ltd can bring a civil suit against you and/or your
company and claim damages, legal fees and an injunction. In
such event, you and and/or your company will be prosecuted
to the fullest extent possible under the law. In a civil action,
Alambik Ltd may chose between the amount we have lost because
of your infringement (actual damages) plus lost profits attributable
to the infringement, and statutory damages in as much as USD$150,000
per unlicensed copy.
In addition, if you or your company reproduces software without
having been grated autorization by Alambik Ltd, or sell, distribute
or expose for sale any unlicensed software, you and/or your
company may face criminal charges. In 1997, in the USA, the
No Electronic Theft (NET) Act was signed into law removing
the profit requirement to be liable for copyright infringement.
Now, software pirates can be prosecuted without making any
money on the illegal software.
